Hi SportWoot folks. Do we get tax free in Texas since it is Texas Tax Free weekend and the backpack is under $100? Those $5 tax dollars would be nice to save. Thanks.

Depends on what you want/need. Kelty generally makes a decent product, for a decent price (I have a Redcloud that I have used for years, including treks to Philmont) , but, as has been noted, this is not a pack for any serious hiking or camping. If price is a major consideration, here's a possibility for just a few bucks more:

Questions re WATERPROOFING
Kelty packs are actually quite water-resistant: the fabric and the zippers are treated. The FAQ notes:

All Kelty packs are coated with a treatment that is highly water resistant. If you are planning a trip that will encounter severe wet weather, or you are concerned about keeping your gear absolutely dry, we recommend purchasing a Kelty rain cover.

The information that came with my pack recommends spraying the zippers with a non-greasy silicone spray every few years, but coating the material in silicone spray, as someone noted earlier (and was highlighted by woot staff with a Que Pee) will violate the warranty. So: spray zippers, not material, and don't worry about rain unless you regularly carry lots of photography equipment or are hiking a rain forest. (FWIW, I've gotten rained on and everything inside in the pack was 100% dry, although I was not. Note: woot hoodies are awesome comfortable when dry, but are not waterproof. )

Sorry dude, I wasn't trying to criticize you. Just wanted to provide some general info so that people who read your post could figure out how to buy and use a pack in such a way as to avoid the problems you cited. I was writing late at night, so I apologize if it came out sounding like a personal criticism. I've edited it to be nicer.

The “Fine Print” – important information you should know about this tax-saving event.
Clothing and Footwear
Backpacks
Backpacks priced under $100 sold for use by elementary and secondary students are exempt during the sales tax holiday. A backpack is a pack with straps one wears on the back. The exemption includes backpacks with wheels, provided they can also be worn on the back like a traditional backpack, and messenger bags.

The exemption does not include items that are reasonably defined as luggage, briefcases, athletic/duffle/gym bags, computer bags, purses or framed backpacks. Ten or fewer backpacks can be purchased tax-free at one time without providing an exemption certificate to the seller.

Bold emphasis is mine, but this isn't really marketed towards school kids, and since it includes the "HDPE frame sheet" it probably does fall under the framed backpack category.

I live in Texas so I would love to save those tax dollars too, but such is not our luck this time around.
